We reserve the right to modify these terms at any time. Your continued use of our services following any changes constitutes your acceptance of the new terms.
2. User Obligations and Acceptable Use
You agree to use our services responsibly and in compliance with all applicable laws and regulations. You must not: (a) engage in any illegal or fraudulent activity; (b) attempt to gain unauthorized access to our systems or other users' accounts; (c) disrupt the normal operation of our platform; (d) use our services to harm, harass, or discriminate against others; (e) transmit malware, viruses, or harmful code; (f) reverse engineer, decompile, or attempt to discover the source code of our platform; (g) use our services for any unauthorized commercial purpose without prior written consent.
3. Intellectual Property Rights
All content, features, functionality, and tools provided by Pleance, including our proprietary software, algorithms, designs, logos, and branding, are the exclusive property of Pleance Inc. and are protected by international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services solely for your authorized business purposes. You may not reproduce, distribute, modify, or publicly display any content without our prior written consent.
4. User Data and Privacy
We take the protection of your data seriously. Your use of our services is subject to our Privacy Policy. By using Pleance, you consent to our collection, use, and processing of your data as described in our Privacy Policy. We implement industry-standard security measures to protect your information. However, no system is completely secure, and we cannot guarantee absolute security of your data.
5. Service Availability and Support
Pleance provides 24/7 customer support to assist with service inquiries and technical issues. While we strive to maintain continuous service availability, we do not guarantee uninterrupted service. We may perform scheduled maintenance that could temporarily affect service availability. We will provide advance notice of planned maintenance when possible. For critical issues, our support team is available around the clock to assist you.
6. Limitation of Liability
To the maximum extent permitted by law, Pleance Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill, arising from or related to your use of our services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these terms shall not exceed the fees paid by you in the twelve months preceding the claim.
7. Service Level Agreement
Pleance aims to maintain a 99% uptime for our core services. In the event of service interruptions caused by our systems, we will work diligently to restore service as quickly as possible. For customers on paid plans, extended outages may qualify for service credits as detailed in your service agreement. Scheduled maintenance and user-caused issues are excluded from our uptime guarantees.
8. Payment and Billing
For paid services, you agree to pay all applicable fees according to the pricing plan you selected. Billing is typically conducted on a monthly or annual basis. You are responsible for providing accurate billing information and notifying us of any changes. We reserve the right to suspend services for accounts with overdue payments. All fees are exclusive of applicable taxes unless otherwise stated.
9. Termination and Account Cancellation
You may terminate your account at any time by contacting our support team. Pleance reserves the right to suspend or terminate your access to our services if you violate these terms, engage in prohibited activities, or fail to pay outstanding fees. Upon termination, your right to use our services ceases immediately. Data associated with your account may be retained for a limited period as required by law.
10. Changes to Services
Pleance reserves the right to modify, update, or discontinue any feature or service at any time. We may add new features, remove existing ones, or change functionality to improve user experience and service quality. We will notify users of significant changes to the platform. Your continued use of our services following such changes constitutes acceptance of the modifications.
11. Third-Party Services and Integrations
Our platform may integrate with or link to third-party services and applications. Pleance is not responsible for the availability, accuracy, or content of third-party services. Your use of third-party integrations is governed by their respective terms and conditions. We recommend reviewing the privacy and terms policies of any third-party services you connect with Pleance.
12. Test Mode and Trial Period
New users are eligible for up to two months of test mode access to our services at no cost. During the test period, full platform functionality is available. Test mode accounts may be subject to usage limitations or data retention policies. Upon expiration of the test period, users must convert to a paid plan or their account will be deactivated.
13. Dispute Resolution
If you have a dispute with Pleance, we encourage you to contact our support team to attempt resolution. Any legal disputes shall be governed by the laws of the jurisdiction in which Pleance Inc. is incorporated. Both parties agree to submit to the jurisdiction of the courts in that location. We reserve the right to pursue any legal remedies available to us.
14. Disclaimers
Our services are provided "as is" without warranty of any kind, express or implied. Pleance disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will meet your specific requirements or that they will be error-free or uninterrupted. Your use of our services is entirely at your own risk.
